Key-note Address
Dear Colleagues & Friends,
We have here, assembled in a very alarming situation when the foundation of our country, the Constitution of India is under severe attack by the existing government from all the sides. The politics is being molded in such a way that it is destroying the finer values of the democracy, plurality, rule of law and harmonious society. The state has been turned into an instrument at hands of capitalistic forces, the media is reduced as propaganda machine promoting the anti-people programs of the government and hostility among various sections particularly between Hindus and Muslims. The well-established institutions of democracy are being torn apart from inside and outside both. The reason is being mocked at and the fiction is being institutionalized at the place of scientific and analytical temper. The dissent and disagreement against the government policies and program is being branded as anti-national. Those who are still at feet to raise voices of conscience are being demonized, jailed and punished. The law of the land is being trampled by the people at the power and at some places like Uttar Pradesh a police state has been made functional to deal with all those who still come forward to claim their rights guaranteed by the law and the constitution.
Even in case of about two dozen killings in UP alone in direct firing by the police no judicial inquiry as compulsory under section 176 Cr.P.C is instituted in gross violation of the law of the land. The notices to confiscate the properties without following the due procedure of law are being rampantly issued to Muslims and no action is in view against the destroying of properties, vehicles and torturing indiscriminate arrest. A reign of terror has been unleashed in furtherance of the threat of Chief Minister Badla lenge. The video clips of SSP Bijnor and SP Meerut are in public domain that are samples of the mentality and strategy of police in Uttar Pradesh. Hordes of unemployed youth under indoctrination are deployed to create havoc, anarchy, hatred, violence, communalism and other criminal acts.
The police personnel themselves had openly replaced the right years where it is seen to destroy the household properties and vehicles entering into peaceful localities. The notices to Muslims to confiscated their properties without following due process of law is are issued and arrest is indiscriminately made to terrorize the people with possibility to oppose the draconian laws like CAA-NPR-NRC and about 6000 persons were detained alone in Uttar Pradesh and threats are looming large for thousands more for further arrest, furthermore at some places when household was looted by the police they were also asked to vacate their houses and migrate from India
Legal fraternity in contemporary time has again been put at a test to take up the cudgels on behalf of the oppressed, needy and victimized people. The lawyers had always been putting themselves at front of every onslaught of injustice and authoritarianism. They have won in the fight during freedom movement and they are further required to involve themselves to strengthen and restore the inclusive, secular and democratic idea of India delivered to us by our forefathers after a long struggle.
Since this government assumed power, undemocratic actions and highhandedness have become a norm. it was unprecedented that the then four sitting Judges of the Supreme Court of India held a press conference and flagged the countrymen that the democracy was in danger. The Director of CBI was unceremoniously removed at 2 o clock at night by sending a contingent of 400 security personnel so that he might be stopped from investigating the Rafael deal. The sealed report of Comptroller and Auditor General of India was produced by the government in Rafael case before the Supreme Court and the Supreme Court relied upon it while it was not even in existence in legal parlance.
We fail in uncertain way to deal with the forces and challenges posed by inner enemies organized to destroy the secular and democratic fabric of the country. Some political leaders have been unashamedly declaring their purpose to come to power to scrap the democratic constitution and to make India a Hindu Rashtra. The slogans of Jai Shree Ram are being chanted in Parliament and Goli Maaro Saalo Ko is the election mantra given by the star campaigners. The message out of these slogans has permitted deeply to the lower layers of society to imitate their leaders and act accordingly. The Election Commission for a long time has failed to rise to the challenges and seemed subdued before the government. The judiciary of the country do not feel empathy and compassion for timely action in removing public grievances and open injustice being perpetrated to the vulnerable citizens of India though some voices of sanity are still heard.
